1. Acceptance of these Terms
These Terms apply to your use of elavinenails.com, booking appointments and receiving services from Elavine Nail Studio (“Elavine”, “we”, “us” or “our”). By visiting the Website, booking an appointment or receiving a service, you agree to these Terms. If you do not agree, please do not use the Website or our services. If you are under 18, a parent or legal guardian must make the booking, agree to these Terms and be present unless we agree otherwise in advance.

2. Our services
We provide manicures, pedicures, gel manicures, acrylic nails, dip powder, nail art and related treatments. Website descriptions, photos and examples are for general information only. The final look, shape, colour and duration depend on your natural nails, choices and products used. Services and availability may change at any time.

3. Appointments and bookings
Book by phone at 416.656.7070 or through our online booking link. You confirm that booking information is accurate and complete. An appointment is confirmed only when we or our booking system confirms it. Please arrive on time. If you are more than 15 minutes late, we may shorten, change or reschedule your service and the full price may still apply. Please tell us when booking if you are bringing a guest or child. Online booking may use a third-party platform whose own terms and privacy policy also apply.

4. Cancellations, rescheduling and no-shows
Please give at least 12 hours notice to cancel or reschedule. A late cancellation or no-show may result in a fee of up to 50% of the booked service price. We may request a deposit or card on file for certain bookings; requirements will be shown at booking. Deposits will be applied to the final bill unless the booking terms say otherwise. If we cancel or reschedule because of illness, emergency or circumstances beyond our control, we will contact you and offer another time. We may waive a fee in genuine emergencies at our discretion.

5. Prices, taxes and payment
Prices are in Canadian dollars and may change without notice. HST and applicable taxes are added. Extra charges may apply for removal, repairs, additional length or detailed nail art; we will explain extra charges before doing the work. Payment is due when your service is completed. We accept cash, debit, major credit cards and other methods displayed in the studio. Tipping is optional and appreciated.

6. Health and safety
We follow cleaning and sanitation practices that meet applicable Ontario public health requirements. Please tell us about allergies, skin or nail conditions, infections, injuries, circulation or sensitivity concerns, pregnancy, medications or anything else that could affect your service. Tell us immediately if you feel pain or irritation and follow our aftercare advice. We may refuse, stop or modify a service if it appears unsafe, including where there is a visible infection, open wound or fungal condition. We may recommend seeing a doctor and will refund a deposit where appropriate.

7. Risks of nail services
Nail services carry ordinary risks, including irritation, allergic reactions, minor cuts or abrasions and infection. By receiving a service, you acknowledge the opportunity to ask questions and accept ordinary risks to the extent allowed by law.

8. Results and satisfaction
If you are unhappy with your service, contact us within 7 days with your concern and, if possible, photos. Where appropriate, we may offer a repair or touch-up at no extra charge. We do not cover damage from accidents, rough use, chemicals, hot water, picking or peeling, natural nail changes, or changes made by you or another provider. We do not guarantee how long a service will last. Refunds are at our discretion except where the law requires otherwise.

9. Conduct in the studio
We may ask you to leave or refuse future service if you or your guests are abusive, threatening, discriminatory, disruptive, intoxicated or damage our property. We are not responsible for resulting loss of your appointment.

10. Personal belongings
Please keep your belongings with you. Except where the law says otherwise, we are not responsible for lost, stolen or damaged personal items, including jewellery, bags, phones and clothing.

11. Photos and social media
We may take photos or videos of finished nails for our portfolio, Website and social media, including Instagram and TikTok. We will not show your face or name without permission. Tell us before your service if you do not want photos. You may ask us to remove a photo of your nails by contacting us.

12. Gift cards and promotions
Gift cards may be used for services and products and cannot be exchanged for cash except where required by law. Promotional offers may have expiry dates and other conditions. Lost or stolen gift cards may not be replaced. Promotions cannot be combined unless stated and may be changed or withdrawn at any time.

13. Use of the Website
You may use the Website for lawful, personal purposes. You agree not to break the law or others’ rights, attempt unauthorized access, interfere with the Website or its systems, copy or scrape content using automated means without written permission, or send spam, malicious code or false information. We may restrict access for maintenance or security.

14. Intellectual property
The Website and its content, including the Elavine name, logo, text, photos, graphics and design, belong to Elavine Nail Studio or its licensors and are protected by law. You may view and share links for personal use. You may not copy, reproduce, modify, distribute or use our content or branding commercially without written permission.

15. Reviews and content you send us
If you post a review, comment, tag us, or send photos or messages, you confirm the content is yours to share and does not break any law or rights. You allow us to share, display and repost it, with credit to your username where possible. We may remove unlawful, offensive or misleading content.

16. Privacy
We collect and use personal information such as your name, phone number, email and appointment details to provide services, manage bookings, communicate with you and meet legal requirements. We handle personal information in line with Canadian privacy law and will not sell it. Please see our Privacy Policy for details about collection, use, storage, protection and access or correction of your information.

17. Third-party websites and services
The Website may link to or use third-party booking platforms, maps, social media and review sites. We do not control these services and are not responsible for their content, availability or practices. Your use of them is at your own risk and under their own terms.

18. Disclaimers
Except where the law says otherwise, the Website and its content are provided “as is” and “as available”, without promises that they will be uninterrupted, error-free or free of harmful components. Website information, including nail care tips, is general information and not medical advice. Please see a qualified health professional for medical concerns.

19. Limitation of liability
To the fullest extent permitted by law, Elavine Nail Studio, its owners, employees and contractors are not liable for indirect, incidental, special or consequential losses arising from your use of the Website or services. Total liability for a service claim is limited to the amount paid for that service. Nothing excludes or limits liability that cannot be excluded under applicable law, including liability for negligence causing injury or rights under consumer protection laws.

20. Indemnity
To the extent permitted by law, you agree to be responsible for losses, claims or costs we incur because you broke these Terms, gave inaccurate health information or misused the Website.

21. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted with a new Last updated date and applies from the date of posting. Continuing to use the Website or services means you accept the updated Terms. Changes will not affect confirmed appointments unless required by law.

22. Governing law
These Terms are governed by the laws of Ontario and applicable federal laws of Canada. Disputes will be handled by the courts of Ontario in Toronto unless the law requires otherwise. We encourage you to contact us first so we can try to resolve concerns together.

23. General
These Terms, booking confirmations, gift card terms and our Privacy Policy form the full agreement about the Website and services. If any part is unenforceable, the rest remains in effect. Not enforcing a part does not waive our right to enforce it later. You may not transfer your rights; we may transfer ours as part of a sale or reorganization.
